Beginning January 17, 2023, new rules apply to residential development on an “infill lot”. Residential development of any building containing 8 or fewer units on any infill lot must follow the infill lot and building standards summarized below.
The purpose of these rules is to set contextually appropriate standards. Applying such standards helps to ensure that the development occurring is similar in scale and placement on the lot as nearby buildings. Conventional lot and building standards have applied the same rules to established neighborhoods as they do to newer ones. Doing so often requires development on infill lots to first obtain variances, which can add considerable time and risk.
The new rules are based upon the surrounding context. Therefore, to determine the specific rules applying to the infill lot, one must identify the context area.
