Criminal/Driving Background Check Disqualifiers

This position requires a criminal background investigation.

These are disqualifiers for employment in a public-safety sensitive position

 Felony Conviction  Permanent
 

Felonies are divided into Class A-E felonies. Examples of the various levels of felony are:

  • Class A felonies: murder, first degree robbery (this is stealing from an actual person) and first degree kidnapping
  • Class B felonies: first degree assault (including domestic assault), voluntary manslaughter, and first degree burglary (this is stealing from a place)
  • Class C felonies: involuntary manslaughter and selling illegal drugs (except less than 35 grams of marijuana)
  • Class D felonies: second degree assault, second degree statutory rape, and illegal gun possession by a felon
  • Class E felonies: first degree stalking (first offense) and fraudulent purchase of a gun
 
 Misdemeanor Class A Conviction(up to 1 year; maximum $2000 fine)  Permanent
 
  • Example: Class A Mis: assault in the fourth degree, rioting, harassment and sexual abuse in the second degree
 
 Misdemeanor Class B Conviction(up to 6 months; maximum $1000 fine)  5 years from conviction date
 
  • Example: Class B Mis: DUI (first offense), reckless driving, speeding in excess of 20 MPH over speed limit, unlawful use of a weapon
 
 Misdemeanor Class C Conviction (excluding traffic) (up to 15 days; <$500 fine)  Two years from conviction date
 
  • Example: Class C Mis: highway littering, animal neglect, refusal to disperse
 
 Two or more Misdemeanor Class B or higher-level convictions  Permanent
 DWI or DUI charge with conviction on a reduced level offense (ex: reckless driving or blocking roadway)  5 years from conviction date
 Misdemeanor Class D or minor traffic violations  3 or more within the last three years to be reviewed by HR Committee
 
  • Example: driving with a revoked license, minor in possession of alcohol, unlawful possession of drug paraphernalia, speeding, disobeying traffic signal
 
 Administrative License Suspension for excessive blood alcohol content or refusing to submit to a breath test  5 years from the time the suspension has been cleared
 Applicant has been terminated, discharged, or resigned by any employer with charges pending from any law enforcement agency for a felony or Missouri class A misdemeanor charge or its equivalent, or an ordinance or statutory violation alleging bodily harm or threat thereof.  Permanent
 Registered as a Sex Offender  Permanent

 

A person is considered to be convicted of an offense when an ADJUDICATION OF GUILT is entered against said person by a court of competent jurisdiction, or a PLEA OF GUILTY is entered. (This includes SIS/SES)
