BZA Meeting Information 

The Board of Zoning Adjustment (BZA) hearings are held on the 2nd Wednesday of every month at 9:00 AM. The hearings are hybrid; both in person at City Hall, 414 East 12th Street, in the 10th floor Council Committee Room, Kansas City, Missouri and virtually via Zoom. Details regarding how to participate virtually can be found below.

Participating In Person

Applicants and members of the public are able to attend in-person meetings. In-person meetings are held in the Council Committee Room on the 10th Floor of City Hall. The entrance to City Hall is off 11th St and requires a security clearance. 

Participating Virtually

Whether you are a citizen, neighborhood organization, or member of an applicant team, you may participate virtually. You will have the same opportunities as you would if you were to participate in person, including the ability to offer a presentation, submit information for the Board's consideration, offer verbal testimony, and be seen (subject to your device’s abilities).

What does this mean for residents?

A resident is anyone other than the applicant or member of the applicant’s team, staff, or the Board members.

As a resident, if you want to watch the meeting but do not want to participate you can simply stream it on YouTube from the comfort and safety of your home. If you wish to participate you will be able to do so remotely using the participation links above. If you plan to participate, please see ground rules below.

What does this mean for applicants?

An applicant is the individual that applied (the applicant) or anyone representing the applicant. In some cases, this the property owner, and/or their architect or surveyor or lawyer, or all four (an applicant team). The applicant, if not the property owner, must submit an Owner Consent Affidavit if the property owner will not be present at the hearing.

Applicants can participate remotely by video conference at the participation links available above. 

Your hearing will follow the same course as it would during an in-person hearing: Staff Presentation>Applicant Presentation>Public Testimony>Applicant Response>Board Discussion & Action. When your case is called, you will have the following privileges:

  1. You will be able to be heard by all participants (make sure you have unmuted yourself).
  2. You will be able to be seen by all participants (make sure your device has a camera and that it is functioning).
  3. You will be able to give a PowerPoint presentation if you desire.

 


Participant Ground Rules

It is important for all participants to keep in mind that public hearings are a special kind of meeting and that there is no video conferencing service specifically developed for public hearings. We are also aware of events which have disrupted public hearings held by video conference. To ensure the hearing functions with minimal interruption and maximum clarity we have established the following ground rules which all participants must follow.

  1. Audio Control: Unmute yourself when speaking and mute yourself when not speaking.
  2. Video Control: Unless you’ve disabled your video, you will appear on screen when speaking. Please be mindful of what is in your background. 
  3. Exhibits: The Board’s rules allow the Chair to admit evidence as exhibits. Typically, this occurs at the hearing with the participant offering a hard copy document or object to the Chair for her review. Because we will be holding hearings virtually a few adjustments must be made. Please read carefully:
    • Exhibits must be emailed to the Project Planner and to publicengagement@kcmo.org no later than 5:00 PM five business days prior to the scheduled hearing. The email subject line shall reference the case number. Your exhibits will be collected by staff and provided to the Chair for her consideration in advance of the hearing. If the Chair chooses to admit the exhibit it will be conveyed visually to the Board during the hearing.
    • Any evidence submitted for an exhibit must be a digital file (pdf, jpeg, or a video). Physical objects or similar which cannot be photographed or scanned and emailed cannot be accepted due to the virtual nature of the hearing. If you believe this prevents a fair hearing you may request the Board grant a continuance to a later date; however it is not yet known when we will be able to resume in-person hearings.
    • All of the Board’s rules regarding exhibits will apply.
Expectations Specific to Applicants

For you to be heard and appear visually before the Board please consider the following:

  1. Identify Applicant Representatives (Required): Please provide the first and last name of all representatives of the applicant who will participate in the video conference so that staff is aware and can give you permissions you need to speak and be seen on Zoom.
  2. Provide a Video (Strongly Encouraged): The Board relies, in part, on videos of the property in question. Typically staff takes this video; however, for the safety of staff and our customers the Board requests that these videos be provided by customers. The video should:
    • Not exceed 20 seconds in length.
    • Show that portion of the property in question (e.g., if the variance is to the rear yard setback the video should show the rear yard).
    • Show a 360 panorama from the camera operator’s point of view to give the Board an idea of the context of surrounding properties.
    • Be a common video file that can be embedded into a PowerPoint.
  3. Provide a Presentation (Optional): Staff offers a presentation on all cases except appeals. If you wish to give a presentation, please limit it to three minutes and make sure it is a PowerPoint file.

Please provide the above-three items no later than 8:00 AM 2 business days prior to the hearing.


What is the Board of Zoning Adjustment?

The Board of Zoning Adjustment (BZA) is an eight member board made up of citizens appointed by the mayor. The BZA hears and makes final decisions on requests for variances from the requirements of the Zoning and Development Code, exceptions to fence height, considers appeals of administrative decisions, and makes final decisions on Special Use Permits.

The Zoning and Development Code designates regulations for residential, office, commercial, institutional and industrial uses. These regulations include requirements for setbacks, height limitations, signage, density, landscaping and allowed land uses. The Zoning and Development Code is adopted by City Ordinance. The BZA may grant relief from specific code requirements.

The BZA considers requests for the following:

  • Variance: In any specific case where strict enforcement of a zoning regulation would cause practical difficulty or unnecessary hardship, the BZA may vary or modify that regulation by granting a variance (Section 88-565).
  • Appeal of Determination: Administrative decisions may be appealed by any person aggrieved by the administrative official’s decision or action. Appeals of administrative decisions will be heard by the BZA to determine if an error has been made (Section 88-575).
  • Request for Rehearing: A rehearing may be granted on any BZA decision if the rehearing request includes new evidence to be presented that was not available at the time of the original hearing or when the BZA determines that good cause for a rehearing has been shown. A request for a Rehearing must be made within 30 days of the date the decision is issued (Sections 88-565-09 and 88-575-11).
  • Special Exceptions to Fencing Requirements: The BZA may grant a special exception to fence and wall height if there is good and sufficient cause and the proposed design will not adversely affect the appearance of the neighborhood or adjacent properties (Section 27-11)
  • Appeal of Legal Nonconformance: Certificates of Legal Nonconformance are issued by the City Planning and Development director. Appeals of the decision may be requested by the applicant or any aggrieved party within 15 days of the date the decision is issued (Section 88-610-01).
  • Special Use Permits: Special uses, because of their widely varying land use and operational characteristics, require case-by-case review in order to determine whether they will be compatible with surrounding uses and development patterns. Special Use Permits are reviewed by the City Planning and Development director, the City Plan Commission, and finally reviewed and approved or denied by the BZA (Section 88-525).
How do I submit an application to the Board of Zoning Adjustment?

Prior to submitting an application you must schedule a pre-application consultation with a staff planner. Prepare all documents as required; see application on CompassKC for details.

What happens after I submit my application to the Board of Zoning Adjustment?

After you submit your application you will be assigned a hearing date and docket time. Staff will prepare a report detailing the request and prepare a PowerPoint presentation. Staff will also send notice of a public hearing to all property owners within 300 feet of the subject property and will publish a legal notice in the newspaper.

The applicant will be given a sign to post on the property at least 15 days prior to the public hearing. An affidavit stating the sign was posted must be received prior to the BZA hearing. Special exceptions to fencing requirements and appeals do not require sign posting.

Any letters of support or opposition submitted to the BZA must be notarized.

A public hearing will be held before the BZA. The property owner or an authorized representative must be present. City staff will present the staff report and Power Point presentation to the BZA. The BZA will then hear testimony from the property owner and/or their authorized representative. Individuals attending the meeting in support or opposition of the application will be given opportunity to testify. The BZA will consider the information presented at the meeting and will move to grant or deny the request. The BZA may also choose to continue the case to allow more time to make a decision or to give the applicant time to modify their request or speak with neighbors.

What happens after the Board of Zoning Adjustment makes a decision?

If your variance or special exception request is granted, a disposition letter and approved site plan will be issued within 10 days of the decision. The submitted site plan will be stamped approved and distributed to the Permitting and Investigations Divisions of the City Planning and Development Department. You may now apply for required permits to begin your project. Fences do not require permits. Approval granted must be established either by use or building permit within two years.

If your variance or special exception is denied, a disposition letter will be sent within 10 days of the decision. In order to receive required permits a new proposal meeting the requirements of the Zoning and Development must be created and approved. If the project has already been built it must be brought into compliance with the Zoning and Development Code. You may also request a rehearing from the BZA or appeal the decision of the BZA to circuit court. Fences do not require permits.

Appeals of Determinations

If the BZA upholds the decision of the administrative official you must bring your property into compliance with the Zoning and Development Code.

If the BZA finds the administrative official erred, your property is deemed in compliance in regards to the specific decision overturned. Additional property violations may still be present on the site.

The BZA 2021 Annual Report is a synopsis of all cases heard by the Board of Zoning Adjustment in 2021. It provides an overview of the operational trends of the BZA in 2021, as well as our action items for 2022. The data analysis for the 2022 Annual Report is underway.
